General Terms & Conditions
- Photographer’s Selection & Editing: Not every image taken during the session will be included in the final gallery. The photographer carefully selects the best images and applies artistic post-processing. Unedited (RAW) files will not be available for viewing, purchase, or delivery.
- Photo Delivery: Photos will be delivered to the client via a private online gallery sent by email and/or WhatsApp messages, from which the client can download images in full resolution. The gallery will be available for 30 days after the delivery date.
- Client’s Responsibility for Backup: Clients should download and back up their photos immediately upon receiving their gallery. The online gallery will remain available for 30 days after the delivery date. If reactivation is needed after expiration, a $50 fee applies. This fee covers the costs associated with long-term storage, external hard drives, and the time required to locate, re-upload, and make files available again. As a small business, managing large amounts of digital files is a significant investment, and files may become corrupted or lost over time. The photographer is not responsible for long-term storage of images.
- Turnaround Time: The online gallery will be delivered within one to two weeks from the session date. Delivery time may vary slightly during peak seasons.
- Usage Rights & Social Media: The client grants Nicole Pierce Photography permission to use images from the session for portfolio, website, social media (Facebook, Instagram, etc.), and promotional purposes. If the client wishes to keep their images private, they must request this before the session date in writing (a message via WhatsApp will work).
- Travel Fees: Sessions taking place outside of the San Juan metropolitan area will incur an additional travel fee. The exact amount will depend on the location and will be communicated at the time of booking.
- Cooperation & Session Flow: The photographer is not responsible for missed or unavailable shots due to lack of cooperation from family members, late arrivals, or unforeseen circumstances.
- Rescheduling & Cancellations:
- If the client needs to reschedule due to illness or unforeseen events, they must provide at least 48 hours' notice whenever possible.
- Sessions may be rescheduled once at no additional cost (this does not apply to seasonal mini sessions). A second reschedule request will be subject to a rescheduling fee.
- During peak seasons (like spring and Christmas when mini sessions are in high demand), photographer availability is extremely limited, and rescheduling may not be guaranteed.
- If the photographer must cancel due to an emergency, the client may choose between a full refund or a rescheduled session.
- Payments & Fees:
- Accepted payment methods: ATH Móvil, Venmo, cash, and check.
- A non-refundable retainer is required to secure the booking, with the remaining balance due the session date. The retainer will be applied toward the total session fee.
- The online gallery will be accessible only after full payment has been received.
- Liability Waiver: The photographer is not liable for any injury, loss, or damage to persons or property during the session. The client assumes all risks and agrees to release the photographer from any claims arising from participation in the session.
- Printing Rights & Recommendations: Clients receive personal printing rights but are encouraged to print through professional labs for optimal quality. The photographer is not responsible for color variations or print quality from third-party labs.
